Terms of Service

Effective October 30, 2026Last updated October 30, 2026Please read Section 19 on dispute resolution

These Terms of Service ("Terms") are a legal agreement between you and C3 Recruits ("C3," "we," "us," or "our") governing your access to and use of our websites, applications, and services (the "Services"). Please read them carefully — they include a disclaimer of warranties, a limitation of liability, and an arbitration provision that affects how disputes are resolved.

Before you start

C3 Recruits is a research, organization, and education platform for college baseball recruiting. We are not a college, a coach, an athletic association, an agent, or a scholarship-granting body. Nothing we provide is a promise of recruitment, an offer, admission, a roster spot, playing time, or scholarship money, and program information in our database can change without notice.

1.

Acceptance of These Terms

By creating an account, subscribing, submitting an application, or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian. By allowing a minor to use the Services, the parent or guardian agrees to these Terms on the minor's behalf and takes responsibility for the minor's use of the Services, including any content posted and any email sent through a connected account.

If you are accepting these Terms on behalf of an organization, club, or high school, you represent that you have authority to bind that organization, and "you" includes that organization.

2.

The Services We Provide

The Services include, depending on your plan and access level:

a searchable database of college baseball programs, filterable by division, region, academics, cost, and program characteristics;

athlete profiles that you can publish and share, including academics, measurable statistics, and highlight video links;

a Recruiting Tracker to organize target schools, contact history, priority, and notes;

coach outreach tools, including AI-assisted email drafting, profile and video link insertion, and engagement reporting;

messaging, a media library of podcasts and newsletters, and partner discount listings;

the Virtual Coach, an AI assistant for platform help, recruiting education, and development guidance;

organization tools for clubs and high schools, including roster management and staff visibility into athlete progress;

the C3 Dugout Fund application process for need-based financial assistance; and

individual consulting and the Recruiting Readiness Assessment.

We may add, change, or discontinue features at any time. Where a change materially reduces what a paid plan provides, we will provide reasonable notice and, at your request, a pro-rata credit for the affected period.

3.

Eligibility, Accounts, and Minors

a. Age and eligibility

You must be at least 13 years old to use the Services, and users under 18 must have a parent or guardian's consent as described above. Organization accounts are available only to authorized representatives of a club, high school, or program.

b. Account accuracy

You agree to provide accurate, current, and complete information — including your name, graduation year, academic information, and measured statistics — and to keep it updated. Recruiting decisions are made by people at colleges based on what you present, and inaccurate information about academics or performance can harm you and others. We may ask you to verify information, and we may correct or remove information we reasonably believe is false or misleading.

c. Account security and one account per person

Keep your login credentials confidential. You are responsible for all activity under your account, including any email sent from a connected account. Do not share credentials, sell access, or create multiple accounts to circumvent limits, suspensions, or quotas. Notify us immediately at support@c3recruits.com if you suspect unauthorized access.

d. Organization accounts and seats

If your account is provided through an organization, the organization controls roster membership and staff access. Organization staff with administrative access can view and manage athlete records for their roster. Access ends when you are removed from the roster or the organization's subscription ends. If access was provided to you as part of a roster, your individual rights under these Terms are limited by the organization's administration of your account.

e. Free and guest access

Some research tools are available without an account. Guest access is provided as-is, may be limited, and does not create a subscription or guarantee continued availability.

4.

Subscriptions, Billing, and Refunds

a. Plans and prices

Paid plans, organization plans, consulting engagements, and assessment fees are described on the applicable plan pages. Prices are in U.S. dollars and exclude applicable taxes, which you are responsible for. Where a plan is offered through a third-party platform (for example, mobile app stores), that platform's billing terms also apply.

b. Automatic renewal

Paid subscriptions renew automatically at the end of each billing period at the then-current rate, using the payment method on file, until you cancel. By subscribing, you authorize recurring charges. We will tell you in advance of any price increase that applies to you, and the new price will apply beginning with your next renewal.

c. Cancellation

You may cancel at any time in Account Settings or by contacting support. Cancellation takes effect at the end of the current billing period; you keep access until then, and no further charges are made after that point. Canceling does not retroactively refund the current period.

d. Refunds

Except where required by law, all fees are non-refundable, and partial billing periods are not prorated. If you believe you were charged in error, contact us within 30 days of the charge and we will review it. If we cancel a paid service you already paid for and cannot provide an alternative, we will refund the unused portion. Nothing in these Terms limits any non-waivable refund right you have under state or federal law.

e. Failed payments and suspension

If a charge fails, we may retry it and may suspend paid features or organization seats until payment is resolved. We may use a payment recovery service to update expired card information. Accounts remain responsible for amounts due for services already provided.

f. Payment processing

Payments are processed by Stripe and, where applicable, the platform through which you subscribed. We do not store full card numbers or bank credentials. By providing payment information, you authorize us and our processor to charge the amounts described. Chargeback abuse may result in suspension.

g. Price changes and plan changes

We may change plan features or prices. Changes to recurring prices take effect on your next renewal after notice, and you may cancel before then. Upgrades may be effective immediately with a prorated charge; downgrades take effect at the next renewal.

5.

Athlete and Family Responsibilities

a. No guarantee of outcomes

We do not guarantee that any athlete will be recruited, contacted by a coach, offered a roster spot, admitted to a college, receive playing time, earn a scholarship, or receive financial assistance. Decisions about recruiting and admission are made solely by colleges, coaches, and admissions offices. We are not a party to any relationship between you and a college.

b. Verify everything that matters

Program details in our database — divisions, conference membership, tuition, academic ranges, scholarship availability, questionnaire links, coaching staff — are compiled from public sources and change frequently. We work to keep it accurate but cannot guarantee it is current or complete. Before acting, confirm details on the program's official website or with the coach.

c. Eligibility and recruiting rules

Academic eligibility and recruiting rules are set by the NCAA, NAIA, NJCAA, and individual colleges and conferences. We are not affiliated with, endorsed by, or an agent of any of those bodies. You are responsible for understanding and following the rules that apply to you — including amateurism rules, contact periods, official and unofficial visit rules, and name, image, and likeness requirements. Consult your school's athletic director, counselor, or the governing body directly.

d. Your own decisions

Guidance from C3 staff, the Virtual Coach, podcasts, newsletters, articles, or assessments is educational. You make your own decisions about which schools to pursue, whom to contact, and what to say. You accept the consequences of those decisions.

6.

Coach Outreach and Email Features

a. You send; we deliver

Our outreach tools help you draft, format, and send recruiting emails from your own email account after you review and approve the content. We do not contact coaches on your behalf, and we do not send cold outreach from a C3 address.

b. Accuracy and truthfulness

You are responsible for the accuracy and legality of every message you send. Do not misrepresent your academics, statistics, videos, achievements, or identity; do not claim offers, interest, or relationships that do not exist; and do not send messages that imply a college has contacted or recruited you when it has not.

c. Anti-spam and volume limits

Comply with the CAN-SPAM Act and all applicable anti-spam and privacy laws. Recruiting outreach must be relevant, non-deceptive, and sent to coaches for recruiting purposes only. We impose daily, monthly, and per-send limits, and we may throttle or suspend accounts that send bulk, repetitive, or unsolicited messages, or messages that generate complaints or bounces.

d. Engagement tracking

Emails sent through the Services may include a tracking pixel and tracked links, which record opens and clicks and show them in your tracker. This tracking is described in our Privacy Policy. Tracking can be affected by the recipient's email client privacy settings, so an "opened" status is an indication, not proof.

e. Replies

Coach replies go to your own inbox, not to C3. We cannot monitor, forward, or respond to them on your behalf, and we are not responsible for a coach not seeing, opening, or replying to your message.

7.

Connected Gmail and Google Terms

Connecting a Google account is optional and uses a send-only permission. When you connect, you authorize us to send messages from that account that you draft and approve in the app. You will also be subject to Google's terms where they apply to your use of Gmail and your Google account.

You may disconnect at any time, after which we can no longer send from that account.

You must not use the connection to send spam, bulk unsolicited mail, or content that violates Google's policies or applicable law.

You are responsible for maintaining your Google account and its security settings; if Google revokes or restricts access, sending features will stop working.

We are not responsible for delays, deliverability, or failures caused by Google, the recipient's mail provider, or your account settings.

Our handling of Google user data is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including the Limited Use requirements.

8.

AI Features and the Virtual Coach

The Services include AI-assisted features such as the Virtual Coach and recruiting email drafting. AI output is generated by third-party models using the prompt and the context provided.

AI output may be inaccurate, incomplete, biased, or out of date. It is not legal, eligibility, financial, admissions, or recruiting advice, and it is not a substitute for your counselor, advisor, or the governing body's rules.

Verify anything important before relying on it, especially academics, eligibility, deadlines, program facts, and costs.

AI drafts are suggestions. You must review and edit every email before sending, and you are responsible for its content once sent.

Do not use AI features to impersonate a coach, college, or another person, to create misleading recruiting claims, or to generate content that violates these Terms.

Do not enter sensitive information — Social Security numbers, financial account numbers, medical details, passwords — into AI chats.

We may review conversations for quality, safety, and abuse prevention. We do not use your content to train generalized AI models.

As between you and us, you own the output of AI features that you generate, subject to the underlying model provider's terms and to our rights in the Services. Similar output may be generated for other users, and ownership does not extend to content that is not yours.

9.

C3 Dugout Fund

The C3 Dugout Fund is a need-based assistance program for athletes and families. Applying is free, and applying does not create any obligation on our part, or on yours, beyond these Terms.

Awards are discretionary, subject to available funding, and are not guaranteed. Meeting the criteria does not entitle anyone to assistance.

Assistance is a grant, not a loan. It is not repayable unless funds were obtained through false or misleading information or were misused, or unless an award agreement says otherwise.

You consent to our verification of the information in your application, including household and financial information, and to our contacting references, coaches, or organizations you list.

Providing false, misleading, or incomplete information may result in denial, withdrawal of an award, a request to return funds, and loss of future eligibility.

Funds may be paid directly to the athlete's family, or to a vendor, program, or organization for the approved purpose, in our discretion.

You are responsible for the tax treatment of any award you receive, and we may issue tax forms or report awards where required by law.

Applications include sensitive household and financial information. Handle it as described in our Privacy Policy, and have a parent or guardian complete and sign any application for a minor.

10.

Individual Consulting and Assessments

Individual consulting, the Recruiting Readiness Assessment, and similar advisory services are educational and advisory. They do not guarantee recruiting outcomes, offers, or placement, and they are not provided by a licensed agent or advisor unless expressly stated.

Fees are stated at checkout and are due in advance unless otherwise agreed.

If you need to reschedule, contact us as early as possible; we will accommodate reasonable requests, and if we must cancel a session you purchased, we will reschedule it or refund it.

Consulting fees are non-refundable once a session has been delivered or an assessment has been completed, except where required by law.

Assessment feedback and recommendations are opinions based on the information you provide. Their value depends on the accuracy of that information.

11.

Acceptable Use

You agree not to, and not to help anyone else:

  1. use the Services for any unlawful purpose, or in violation of recruiting rules, anti-spam laws, or another person's privacy or publicity rights;
  2. harass, threaten, defame, or discriminate against any coach, athlete, staff member, or user;
  3. impersonate any person or organization, or misrepresent your affiliation with a college, program, or C3;
  4. upload or send content that is false, deceptive, infringing, obscene, or harmful, or that contains malware;
  5. upload another person's information, transcripts, or documents without their permission, or the permission of their parent or guardian if they are a minor;
  6. copy, scrape, harvest, or bulk-download the program database, coach contacts, or other users' profiles, or use automated means to access the Services;
  7. reverse engineer, decompile, probe, or attempt to circumvent access controls, rate limits, quotas, or plan restrictions;
  8. resell, sublicense, or provide the Services to third parties except as expressly permitted for organization accounts;
  9. interfere with the operation of the Services, or place unreasonable load on our infrastructure;
  10. use the Services to build a competing product or to train another model on our data;
  11. send email through a connected account to recipients who did not provide their contact details for recruiting purposes, or in a manner that generates complaints;
  12. collect or store another user's personal information from the Services without consent; or
  13. use AI features to deceive, to fabricate achievements or offers, or to generate outreach at scale.

We may investigate suspected violations, remove content, and suspend or terminate access. We may also report unlawful conduct to appropriate authorities.

12.

Your Content and Licenses

a. You own your content

You retain ownership of the content you submit — profile information, statistics, videos, documents, messages, notes, and photos ("Your Content"). You are responsible for having the rights to submit it, including any photo, video, or highlight reel that shows or was created by someone else.

b. License to operate the Services

You grant C3 a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and process Your Content as needed to provide and improve the Services — for example, rendering your profile, generating an email draft with your links, and displaying your information to people you share it with. This license ends when you delete the content or your account, except for copies retained in backups or as required by law, and except for content already sent to a third party (such as an email a coach received).

c. Public visibility

If you publish a profile or share a link, you understand that the information on that page can be viewed by anyone, including coaches and the public, and may be indexed by search engines. Do not publish information you want to keep private.

d. Name, image, and likeness

We will not use an athlete's name, image, or likeness in C3 marketing or advertising without written consent from the athlete and, for a minor, from a parent or guardian. Separately, you are responsible for complying with name, image, and likeness rules that apply to you.

e. Feedback

If you send us suggestions or feedback, we may use it without restriction or compensation. Do not send us confidential information or ideas you want to keep proprietary.

f. Removal

We may remove or refuse content that violates these Terms, infringes rights, or creates risk for users or for us. We are not obligated to monitor content, but we may do so.

13.

Our Intellectual Property

The Services — including the software, interface, design, program database, editorial content, podcasts, newsletters, assessments, and the C3 Recruits name and logos — are owned by C3 or our licensors and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial recruiting purposes (or, for organization accounts, for the organization's internal use within its seat limits), subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Services or the program database, or use our marks without written permission.

Program information is compiled from public sources and presented in our own format; the compilation, structure, and presentation belong to us. Individual facts about colleges are not owned by anyone.

14.

Third-Party Services and Data

The Services rely on third-party providers — hosting, authentication, payments, email delivery, AI models, and media hosting — and link to outside sites such as college athletic pages, video platforms, and partner brands. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by its own terms, and a partner discount is an agreement between you and that partner.

College names, logos, and team marks belong to their respective institutions and appear for identification purposes only. Their appearance does not imply any affiliation with or endorsement by those institutions.

15.

Disclaimers of Warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, C3 disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free; that data will be accurate, current, or complete; that defects will be corrected; or that any recruiting, admissions, financial-aid, or athletic outcome will result from using the Services.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

16.

Limitation of Liability

To the fullest extent permitted by law, C3, its officers, employees, advisors, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, opportunities, scholarships, roster spots, data, goodwill, or recruiting outcomes, arising out of or relating to the Services or these Terms, even if advised of the possibility.

Our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid to C3 in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars.

These limits apply regardless of the theory of liability and survive termination. They do not limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited by law. Some states do not allow certain limitations, so parts of this section may not apply to you.

Each provision of this section applies separately. If one is found unenforceable, the others remain in effect.

17.

Indemnification

You agree to defend, indemnify, and hold harmless C3 and its officers, employees, advisors, contractors, and suppliers from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Services; Your Content, including uploaded documents and video; emails or messages you send through the Services; your violation of these Terms, of recruiting rules, or of any law; your violation of another person's rights, including privacy, publicity, or intellectual property rights; or a dispute between you and a college, coach, organization, or another user.

Where a claim concerns a minor's use of the Services, the parent or guardian who accepted these Terms is responsible for this obligation. We will notify you of a claim and may participate in its defense at our own expense.

18.

Suspension and Termination

a. By you

You may stop using the Services and cancel or delete your account at any time. Cancellation of a subscription takes effect at the end of the current billing period, and deletion permanently removes your profile and data subject to the retention periods in our Privacy Policy.

b. By us

We may suspend or terminate your access, remove content, or decline to renew a plan if you violate these Terms, create legal or security risk, send abusive or unlawful outreach, fail to pay, or if we discontinue a feature or the Services. Where reasonable, we will give notice and an opportunity to fix the issue.

c. Effect of termination

On termination, your license to use the Services ends. Sections that by their nature should survive — including content licenses for already-distributed material, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — survive. We are not liable for the loss of data resulting from termination for cause, though you may request an export before termination takes effect.

19.

Dispute Resolution and Arbitration

a. Talk to us first

If you have a dispute, send a written description and your requested resolution to support@c3recruits.com with the subject "Notice of Dispute." We will try to resolve it within 30 days. This informal step is required before starting arbitration or a small claims action, except for claims about intellectual property or unauthorized access.

b. Binding arbitration

If we cannot resolve the dispute informally, you and C3 agree that the dispute will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except as described below. The arbitrator may award the same relief a court could award for an individual claim, and judgment on the award may be entered in any court with jurisdiction.

c. What is excluded

Either party may bring an individual claim in small claims court if it qualifies. Either party may seek injunctive or equitable relief in court to protect intellectual property, confidential information, or the security of the Services. Claims that cannot lawfully be arbitrated are excluded.

d. Class action waiver

You and C3 agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, unless the law where you live prohibits this. If this waiver is unenforceable as to a claim, that claim proceeds in court and the rest of this section still applies.

e. Your right to opt out

You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@c3recruits.com with the subject "Arbitration Opt-Out," stating your name, account email, and that you decline arbitration. Opting out has no other effect on your account. If you opt out, disputes will be resolved in the courts described in Section 20.

f. Minors and parents

For a user under 18, the parent or guardian who accepted these Terms may exercise the opt-out on the minor's behalf. If a dispute involves a minor and arbitration is not enforceable where the minor lives, the dispute will be resolved in court as described in Section 20.

g. Arbitration costs

We will pay the arbitration filing and administrative fees that the AAA rules require us to pay for a consumer claim. Each party bears its own attorneys' fees except where a statute or the arbitrator's award provides otherwise.

20.

Governing Law and Venue

These Terms are governed by the laws of the state in which C3 Recruits maintains its principal place of business, without regard to its conflict-of-laws rules, and by applicable United States federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to Section 19, you and C3 agree to the exclusive jurisdiction of the state and federal courts located in the county and state of our principal place of business for any dispute not subject to arbitration. Nothing in this section prevents you from bringing a claim in your local small claims court where permitted, or limits any consumer protection right you have in your state of residence.

21.

Copyright Complaints

If you believe content on the Services infringes your copyright, send a written notice to our designated copyright agent at support@c3recruits.com with the subject "DMCA Notice," including: your physical or electronic signature; identification of the copyrighted work; identification of the material you claim is infringing and its location; your contact information; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your consent to the jurisdiction of the federal court in your district.

We will remove or disable access to material we determine to be infringing and may terminate the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you may send a counter-notice to the same address. Knowingly submitting a false notice can result in liability for damages.

22.

Changes to These Terms

We may update these Terms as our Services or the law change. When we do, we will revise the effective date at the top of this page. If a change materially affects your rights or obligations, we will notify you by email or in-app before it takes effect. Continued use of the Services after a change takes effect means you accept the updated Terms; if you do not agree, you may cancel and stop using the Services.

23.

General Provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and C3 regarding the Services, and supersede prior discussions. Plan pages, order forms, and award agreements supplement them; if there is a conflict, the more specific document controls for that subject.

Severability. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain in effect.

No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages, cyberattacks, natural disasters, or third-party service failures.

Electronic communications. You consent to receive agreements, notices, disclosures, and receipts electronically, which satisfies any legal requirement that they be in writing. Keep your email address current.

Notices. Legal notices to us must be sent to support@c3recruits.com. Notices to you may be sent to the email address on your account or posted in the Services.

Independent parties. These Terms do not create a partnership, agency, joint venture, or employment relationship. You and C3 are independent parties.

Headings. Headings are for convenience and do not affect interpretation.

Survival. Provisions that by their nature should survive termination do survive, including Sections 12, 13, 15, 16, 17, 19, and 20.

24.
